questions

Should most acting positions of responsibilty be advertised?

questions

Yes

answers

Members have recently informed TCEEA officers that in some cases Acting Positions of Responsibility are not being advertised before being filled.

This is quite clearly a breach of the Catholic Education Agreement as only in 'Exceptional Circumstances' is this allowable. The union needs to be notified through the Rep if positions are being filled becaused of 'Exceptional Circumstances' so that we can follow up and ascertain whether there really are 'exceptional circumstances'.
Members please be vigilant about this and let us know if this is happening in your school. The Agreement clause in the Catholic Education Agreement is:

(c)Where an Acting appointment is to be made for a Position of Responsibility, the following guidelines are to be observed:
(i)Other than in exceptional circumstances, Acting positions shall be advertised within the school. All staff shall be notified of the vacancy in writing.
(ii)Advertisements shall be displayed for a minimum period of 7 calendar days before applications are closed.
(iii)In exceptional circumstances the employer may make an Acting appointment without advertisement.

'Exceptional circumstances' would include situations where insufficient notice is given by the incumbent of an intention to be absent from duty, or where sudden or unforeseen situations arise and an urgent appointment must be made to ensure continuity in the operation of the school.
(iv)Where appointments are made under the 'exceptional circumstances' provision, and the incumbent will not be resuming the position, that position will be advertised as soon as practicable.
(v)No Acting appointments shall exceed one year in duration, or the length of absence by the incumbent, whichever is the shorter.
(vi)If after advertisement no suitable applications are received, the employer may make an Acting appointment.
