workers Compensation Changes

There have been recent changes to the Workers Rehabilitation and Compensation Act. The following is a summary of the amendments:

STEP DOWNS IN WEEKLY PAYMENTS OF COMPENSATION PRIOR TO THE 29TH JUNE 2004:
0-13 weeks - 100% of normal weekly earning
14-52 weeks (12 months) - 85% of normal weekly earning
53 weeks to a maximum of 10 years - 70% of normal weekly earning

STEP DOWNS FOLLOWING LEGISLATION ON AND AFTER THE 29TH JUNE 2004:
0-13 weeks - 100% of normal weekly earning
14-78 weeks (18 months)- 85% of normal weekly earnings
79 weeks to a maximum of 9 years - 80% of normal weekly earnings

THE CHANGES APPLY TO:
.workers who suffered injuries before 1st July 2001; and
.workers who suffered injuries on or after 1st July 2001 and have received a settlement or common law damages award in respect of their claim.
