TCEEA Policy on Legal Assistance
1. All TCEEA members have access to an initial appointment with the TCEEA legal advisers, McLean, McKenzie & Topher or Wallace, Wilkinson & Webster free of charge on any matter either work related or private.
2. In addition to this the TCEEA maintains a Legal Contingency Fund. Financial help may be provided to members for legal advice and representation in matters, civil and criminal, arising directly from their employment on application to the Committee of Management.
3. To access the Legal Contingency Fund applications must be tabled at a Committee of Management Business Meeting.
4. Such applications will be discussed in confidence. The decision of the COM will be conveyed to the member concerned by the Secretary/Treasurer.
5. Access to the Legal Contingency Fund is conditional on the member using either of the TCEEA law firms that the TCEEA has a partnership arrangement with.
6. The COM reserves the right to make a determination to meet a proportion of costs based on the particular circumstances of the matter. As a basic principle the TCEEA could contribute no more than 50% of any costs incurred.
7. The union, guided by the advice of personnel at the law firms that the union has a partnership arrangement with as to the likelihood of successful action, will not contribute towards cases which professional advice indicates are unlikely to be successful.
8. In relation to Workers Compensation matters: (a) the union will provide an initial appointment with a legal adviser as in Point 1 above and continuing union officer support up to the stage of a Section 81A "Genuine Dispute" Hearing. (b) The union not provide financial support for Worker's Compensation matters beyond a Section 81A "Genuine Dispute" Hearing.
Exclusions:
(a) The union is not responsible for any costs incurred privately by a member.
(b) The union will not meet legal costs where the member seeks advice without the union's authorization.
