Extra Curricular time

We regularly receive many phone calls in relation to school camps. Some of the queries are about the extra expenses incurred, time away from the family and duty of care and related matters.

Clause 1 of Part V - Hours of Work and Overtime, of the Catholic Education Award refers to Extra Curricular / co-curricular Activities. It reads "The arrangements where by members of the Association and other teachers are available for extra - curricular and / or co-curricular activities of the school but outside normal school hours will continue without the Association introducing any claims for additional remuneration or conditions. In return the employers will not extend such requirements beyond the present practices."

This will be interpreted by both parties as applying to the incidence of such activities across the whole of a school and not in respect of individual teachers.

This clause in using the words "are available" indicates that those who take on extra / co curricular duties do so voluntarily.

This clause does not use 'shall be available" or other proscriptive language.'

The clause is also silent in relation to any penalty that might be enacted against those who do not do extra / co-curricular duties. Maybe staff are not involved in extra / co-curricular activities for all sorts of legitimate reasons.

This clause could also be interpreted as applying only when extra / co-curricular activities are conducted across the whole of the school, eg school sports day, athletic carnivals etc.
